(“operator”). It has made the travel arrangements as agent for the
trans¬portation carriers and other suppliers of services connected with
the tour, all of which are independent contractors. Operator in no way
owns or operates the vehicles or facilities to be used dur¬ing the trip,
and does not guarantee or assume responsibility for the acts and/or
omissions of suppliers, their employees, agents, etc. All bookings are
accepted subject to the conditions imposed by suppliers & operator,
including airline, cruise line, rail, coach, hotel, restaurants, insurance
and other companies, firms or persons concerned with the trip, and
operator will make no refund in the event of their delay, cancellation,
overbooking, strike, force majeure or for elements of the package not used
by customer. If there is a difference between operator Conditions and
those published by a supplier, the conditions of supplier shall apply.
Price quoted is per person double occupancy. Operator reserves the right
to cancel a trip, change the itinerary or adjust rates whenever in its
sole judgment conditions warrant, or if operator deems it necessary for
your comfort, convenience or safety. Trips outside the USA require a valid
passport or other acceptable forms of citizenship proof. You are
responsible for, and release operator from passport, visa, vaccination
requirements, and safety conditions in travel destinations. Operator
strongly recommends you purchase appropriate cancellation/medical/ baggage
insurance for the trip, which is available from operator. Operator
reserves the right to decline to accept any person as a member of the
tour, or to require any participant to withdraw from the trip at any time
who presents a significant risk to the health or safety of himself or
others which can not be eliminated or reduced to an acceptable level by
operator’s reasonable accommodation. Operator reserves the right to
correct an error in the brochure presentation or advertised price prior to
your departure. A contract is made when your reservation and payment are
accepted by operator at it’s office, and any dispute shall be governed
by Massachusetts law and subject to the jurisdiction of Suffolk County,
Massachusetts. In calculating the cost of your trip, the operator has
relied on your consent to these terms and in the absence of this release,
the trips cost would have been higher. Operator reserves the right to
substitute hotels of similar quality at any time or to make changes in
itinerary to a similar quality. Operator will not be responsible to any
person for expense, loss of time, money or other circumstances resulting
from a change in itinerary or change of tour arrangements. Operator also
reserves the right to cancel a tour prior to departure, and in such cases
all payments made to date will be refunded and shall constitute full
settlement. If you purchase an airline ticket separately, it is your
responsibility to ensure you understand the conditions under which the
ticket is issued as operator assumes no responsibility for such airline
ticket cancellation fees. Please understand that not all museums and
attractions are open every day of the year. Operator reserves the right to
vary the sequence of sightseeing and/or to reroute the order of cities if
that will enable you to visit all listed Excursions. In either case, the
itinerary content will be maintained to the extent possible and there are
no refunds for any unused or unavailable excursions.
Important Note On Prices: All prices and
conditions of travel are based on currency, fuel, and VAT rates in effect
on October 1 2006. All rates are subject to change without notice due to
currency exchange fluctuation, fuel or VAT increases.
Documentation
All tour documentation will be sent out to
the travel agent approximately 21 days prior to the departure of the tour,
provided full payment has been received. In the event this is not
acceptable, we require sufficient notice in order to avoid express
shipping charges. If we are not given sufficient notice, the passenger or
travel agent will be responsible for express delivery charges.
- Passport Requirements:
It is the sole responsibility of each passenger to obtain the
necessary documents for travel, not excluding passports and visas. A
valid passport is normally the only requirement for U.S. citizens.
Visa requirements do change without notice and vary by nationality.
Please check with the consulate office of the destination country as
to visa requirements.
- Tour Cancellations:
Tour departures are not guaranteed. If it becomes necessary to cancel
a coach tour prior to departure, we will offer the next available date
at no additional land cost. If this is not acceptable, a full refund
on all monies paid will be made. We cannot accept responsibility for
any additional costs or fees relating to such a tour booking. If you
purchase a non-refundable airline ticket, you are advised by these
terms and conditions that we are not responsible for any cancellation
penalties due to non-refundable airfares.
- Baggage:
Motor coach luggage compartments require the restriction of one large
suitcase and one carry-on bag per person. Wheeled carry-on bags are
not suitable as hand luggage on motor coaches. Airline baggage
allowance is restricted to two bags per person and airlines at their
discretion may restrict the size and weight of your luggage. No
responsibility by BMIT is accepted for loss of or damage to baggage or
any of the passenger’s belongings. No responsibility by BMIT is
accepted for loss of or damage to baggage or items left on the bus
during the day. We recommend you to purchase Travel Protection.
- Coach Tours:
Motor coach tours are normally operated by 44 to 53 seat motor
coaches. When passenger numbers are low, a smaller coach may be used.
Smoking is not allowed on motor coaches or minibuses. In order to
ensure congenial membership, the tour company reserves the right to
accept or reject any person as a tour participant and to expel from
the tour any participant whose conduct is deemed incompatible with the
interests of the tour group.
- Hotel Accommodation:
Hotel accommodation will be supplied as described. On certain
departures, due to seasonal demands, we reserve the right to alter
itineraries and substitute hotels for similar type accommodations.
- Air-conditioning:
Although available at most of the hotels offered in our escorted tour
programs, conditions and use of air-conditioning abroad differs
greatly from the United States. Many European hotels were built before
central air-conditioning was introduced. Air-conditioning is often
shut down at night.
- Health requirements:
Tour members should check with the consulates and/or the local health
boards for the latest health requirements.
- Travelers who need special
assistance:
Any disability requiring special attention must be reported to the
tour company at the time of booking. The tour company will make
reasonable efforts to accommodate the special needs of disabled tour
participants, but is not responsible for any denial of services by
carriers, hotels, lodges, restaurants, or other independent suppliers,
nor any additional expenses incurred. Motor coaches and minibuses are
not equipped with wheelchair ramps. Individual assistance cannot be
provided to a tour member for walking, dining, getting on/off motor
coaches and other transportation vehicles, or other personal needs.
Travelers who need assistance must be accompanied by a qualified and
physically able companion. Motorized scooters are unsuitable for
touring.
